Terms & Conditions
Between: Pioneer Data Engineering (PDEN)
and: Client of PDEN residential, industrial and commercial security systems
1. SECURITY SYSTEMS INSTALLATION AND SERVICE CONDITIONS
1.1. Client’s Responsibilities:
The client is responsible for providing PDEN with accurate and timely information regarding the installation site, including:
- 1.1.1. Work Notification: The client must provide at least seven days' notice for any work required by PDEN.
- 1.1.2. Accurate Plans: An accurate site plan must be provided, including precise locations for security cameras and DVR/NVR systems. Any requests to reposition cameras after installation will incur additional charges. The client is responsible for repairing any holes or cut-outs resulting from repositioning.
- 1.1.3. Equipment Location Confirmation: The client must confirm the location of control panels, keypads, detectors, and sirens. Any requests for repositioning these items post-installation will result in additional charges, and the client is responsible for repairing any leftover holes or cut-outs.
- 1.1.4. Data and Internet Connection: A working data point and active internet connection are required for remote viewing, arming/disarming, and receiving notifications on smart devices.
- 1.1.5. Wall Boxes Installation: If the installation requires wall boxes in brickwork, the client must provide them unless otherwise agreed in writing by PDEN.
- 1.1.6. Electrical Door Locks: The installation of any electrical door locking devices is the client's responsibility unless agreed otherwise in writing by PDEN.
- 1.1.7. Power Supply: The client must provide a 240V power outlet at the location of the recorder.
- 1.1.8. Auxiliary Equipment: The client is responsible for ensuring the connection of any auxiliary equipment where applicable.
1.2. Post-Installation Responsibilities:
The client acknowledges that they are solely responsible for the following post-installation conditions:
- 1.2.1. Wiring Damage: Any damage to the wiring after installation is the client’s responsibility.
- 1.2.2. Electrical Door Locking Devices: The client is responsible for the fitting of any electrical door locking devices unless specified in the scope of work.
- 1.2.3. Trenching: All trenches required for wiring must be prepared by the client before installation unless otherwise specified in writing by PDEN.
1.3. Construction Sites:
For buildings under construction, the client acknowledges the following:
- 1.3.1. Visibility of Security Wiring: All security wiring must be left visible by the plasterer, carpenter, tiler, or other tradespeople employed by the client’s builder before PDEN completes the installation.
- 1.3.2 Cable Locating Costs: PDEN's quotation does not cover the cost of locating cables not left visible in plaster during construction. The client is responsible for these additional costs.
1.4. Training and Hand Over:
Upon completion of the installation, the client or an authorized representative must be available to receive training on how to use the system and ensure programming on the mobile or main device is to their satisfaction. If additional visits are required for further training or setup, these will incur extra charges.
2. GENERAL INSTALLATION SERVICE CONDITIONS
2.1. Site Preparation:
The installation site must be clear and free from obstruction before work begins. PDEN will conduct a site inspection on the day of installation. PDEN accepts no liability for delays caused by obstructions, hazardous site conditions, or structural defects that impact the installation schedule.
2.2. Elevated Work Platform (EWP):
Where installation requires access higher than 3 meters, an Elevated Work Platform (EWP) may be needed. The cost of EWP hire, unless specified in PDEN’s quotation, will be the client’s responsibility. PDEN can arrange EWP hire on behalf of the client, but all associated costs will be added to the final invoice.
2.3. Structural Issues:
Clients must inform PDEN of any known structural issues before work begins. PDEN is not responsible for damages caused by defects in the building structure (e.g., fragile walls or ceilings, aging materials). Minor damages incurred during installation will be the responsibility of the client, especially in cases where defects are pre-existing.
2.4. Equipment Location:
PDEN reserves the right to adjust equipment locations by up to 1 meter if necessary for structural reasons or installation feasibility. This decision will be communicated to the client prior to installation.
2.5. External Interference:
PDEN is not liable for interference to systems (e.g., intercoms, alarms, CCTV) caused by external electrical sources, including but not limited to dimmers, electrical appliances, radio signals, or other nearby electrical fields. These issues are outside of PDEN’s control and will not be covered under warranty.
2.6. Device Training:
Training on system use will be provided on the day of installation. Any additional training sessions will be charged at the standard service rate. Clients are encouraged to ensure all relevant parties are available for training during installation.
3. QUOTATION
3.1. Validity of Quotation:
Unless otherwise stated in writing, PDEN’s quotations are valid for 30 days from the date of issue. After this period, PDEN reserves the right to review and amend the terms of its offer, including pricing and scope of works, to reflect any changes in material costs, site conditions, or other relevant factors.
3.2. Site Visit Fees:
The quotation includes two site visits, unless otherwise specified. The cost of site visits is calculated from PDEN’s office location to the client’s site. Any additional site visits requested by the client, or necessitated by unforeseen circumstances, will incur additional charges at the standard service rate.
3.3. Delays Due to Site Conditions:
PDEN cannot be held liable for delays caused by site conditions that were not communicated in advance. If unforeseen circumstances, such as adverse weather or unprepared site conditions, cause the delay, PDEN reserves the right to reschedule the installation. PDEN is not responsible for any resulting financial losses incurred by the client due to these delays.
3.4. Client Availability During Installation:
The client or the client’s authorized representative must be available throughout the installation and commissioning process to provide any necessary approvals or instructions. If the client is unavailable and additional site visits are required to complete the work, these will be charged as additional service calls.
3.5. Cancellation of Agreed Work:
Clients must provide a minimum of 24 hours’ notice to cancel or reschedule agreed installation work. Failure to provide adequate notice will result in a cancellation fee equivalent to 10% of the quoted value or a standard service call fee.
4. VARIATIONS
4.1. Scope of Quotation:
PDEN’s quotations are based on the information and scope of works provided by the client at the time of issue. Any variations to the agreed scope of works will require PDEN to amend the quotation to reflect any additional costs incurred. This includes changes requested by the client after the initial quotation is issued or after work has commenced.
4.2. Client-Initiated Variations:
If the client requests any changes to the scope of works during installation (e.g., repositioning equipment, adding or removing components), PDEN will issue a variation report detailing the changes and associated costs. The variation report must be approved and signed by the client before any additional work can commence.
4.3. Unforeseen Variations:
PDEN reserves the right to alter the scope of works if unforeseen circumstances arise (e.g., structural issues, access limitations) that require changes to the original installation plan. In such cases, PDEN will inform the client and provide a revised quotation for approval. The client will be responsible for any additional costs incurred due to these variations.
4.4. Documentation of Variations:
All variations must be documented in a written report that fully details the nature of the variation, the reason for the change, and any resulting cost adjustments. This report must be signed by both PDEN and the client before work can proceed. Verbal agreements for variations will not be accepted as binding.
5. PAYMENT TERMS
5.1. Invoicing:
PDEN will issue invoices upon the completion of each stage of the project, unless alternative arrangements have been made in writing. Payment terms are strictly 2 days from the date of the invoice.
5.2. Late Payments:
Any invoice not paid within the agreed payment terms will incur a late fee of 1% per day, starting from the due date. PDEN reserves the right to suspend ongoing services or future work until all outstanding payments have been cleared.
5.3. Debt Recovery:
If payment is not received within 30 days of the invoice date, PDEN reserves the right to recover all outstanding costs, including any legal fees, collection fees, and other related charges incurred during the recovery process.
5.4. Title of Goods:
Ownership of goods provided by PDEN will not transfer to the client until full payment has been received. PDEN reserves the right to retrieve and repossess any equipment that remains unpaid, including entering the client’s premises to recover the equipment, without prior notice if necessary.
5.5. Cancellation Policy:
Clients must provide a minimum of 24 hours notice to cancel or postpone any agreed work. Failure to do so may result in a cancellation fee equal to a service call-out charge or 10% of the quoted project value.
5.6. Service Call Fees:
Any additional site visits or service calls requested by the client, outside of the scope of the original agreement, will be billed at the standard service rate.
6. Refund Policy
6.1. No Refunds for Change of Mind:
PDEN is not required to provide a refund or replacement if the client changes their mind after the purchase. However, if the product or service has a major defect or is significantly different from the description provided, a refund or exchange will be offered.
6.2. Major Problems:
The client is entitled to a refund or replacement if the item:
- Is unsafe to use.
- Is significantly different from the description or sample.
- Does not function as promised and cannot be repaired easily. If the client opts to keep the item, PDEN will offer compensation for the reduced value of the product or service.
6.3. Repair and Replacement:
If a product or service has a minor issue, PDEN will repair it within a reasonable time frame. If repairs are not possible within a reasonable time, the client can opt for a refund or replacement. PDEN is not responsible for issues caused by misuse, incorrect installation (if not done by PDEN), or external damage.
7.Warranty Provisions
7.1. Professional Services Warranty:
PDEN guarantees that all professional services will be carried out using industry-standard practices. If the client identifies any non-conformance with these standards within 30 days of service completion, PDEN will re-perform the service at no additional charge.
7.2. Deliverables Warranty:
PDEN warrants that deliverables (e.g., installed equipment) will meet the agreed-upon criteria for a period of 30 days following acceptance. If any issues arise within this period, PDEN will attempt to correct the issue. If the issue cannot be resolved, the client is entitled to a refund for the defective portion of the deliverable.
7.3. Warranty Exclusions:
The following are not covered under PDEN’s warranty:
- Changes or modifications made to the system without PDEN’s prior written consent.
- Issues arising from third-party software or hardware.
- Misuse or incorrect operation of the system by the client or a third party.
- Non-PDEN branded products (warranties for third-party products must be pursued with the original manufacturer).
7.4. Backup Systems:
PDEN does not provide a warranty for the ongoing operation of backup systems unless a maintenance agreement is in place. The client is responsible for regular maintenance of backup systems to ensure functionality.

Modifications:
We may update these Terms at any time. Continued use of the Site means you accept changes.
Intellectual Property:
All content and trademarks on the Site are owned by us. You may use content only for personal, non-commercial purposes with our permission.
User Representations:
You must be of legal age and comply with these Terms. You must not use the Site for illegal purposes or provide false information.
Products:
We strive for accuracy in product details but do not guarantee them. Availability and prices may change.
Purchases:
We accept credit cards, PayPal, and bank transfers. Prices are in Australian dollars. We reserve the right to correct pricing errors and limit or cancel orders.
Prohibited Activities:
You may not use the Site for commercial purposes or violate laws.
User Contributions:
If you submit content, you guarantee it doesn’t infringe on others’ rights and complies with our guidelines.
Submissions:
Any feedback or suggestions you provide are non-confidential and become our property. We may use them without compensation to you.
Site Management:
We can monitor, remove content, and take legal action against violations. We are not responsible for interruptions or errors in Site availability.
Limitation of Liability:
We are not liable for damages arising from your use of the Site. Our liability is limited to the amount you paid, if any.
Indemnification:
You agree to indemnify us against claims arising from your use of the Site or violation of these Terms.
User Data:
We are not liable for data loss or corruption. You are responsible for backing up your data.
Electronic Communications:
By using the Site, you consent to electronic communications and signatures.
Miscellaneous:
These Terms constitute the entire agreement. If any part is unenforceable, the rest remains valid. We may assign our rights and obligations. No joint venture or partnership is created.
